Legislative News November 2010

The election on November 2 will cause quite a few changes in the legislative arena.  There were several issues that came up before the election.  In the October issue of the ANA Smart Brief, The FDA’s public health plan placed high priority on IT innovation within the agency as well as promote collaboration with other government units.  The Information Technology Strategic plan will be phased in over five years and the FDA will be seeking public input on the proposal.  Also in October there was a report about insurers refusing to cover one in seven in applicants for insurers that have health histories.  Health reforms that ban such actions don’t kick in until 2014 but such consumers with these pre-existing conditions can get coverage through employer or government programs.

As we all know by now there were some significant changes in the US Legislature with the Republicans being the dominant party in the House as of January 1st.  Although the Senate will still be Democratic, the Republicans made some additions there as well.  The GOP gains may complicate the health reforms planned by President Obama, especially in the House.  While the total repeal of these plans is unlikely the majority may try to eliminate some of the funding for the reform provisions. Even in the Senate, Senator Mitch McConnell, R. Ky. said he will be seeking ways to deplete the financial resources of the law working toward full repeal by 2013 and replacing the existing law with common sense reforms to reduce spending.

As I reported in the last newsletter, there has been no movement on those bills relating to us in AORN.  I did see on the website that California is seeking a new State Legislative Coordinator.  There will also be some changes to AORN advocacy news in the January 20011.  The association discovered in a membership survey there is a need for an inclusive resource with all the information members need on advocacy, practice resources education and association news.  There will be a consolidation of all this information into one weekly e-news source—the Period Insider.  You can learn more about these changes by visiting aorn.org/FindYourNews.

I will report on these issues at a later date.
